EU AI Act for U.S. insurance AI companies

Annex III specifically lists AI intended for risk assessment and pricing in relation to natural persons for life and health insurance. That does not make every insurance AI system high-risk.

Updated and legally reviewed: 29 September 2026.

Direct answer

Classify the insurance use case, not the insurer.

Life and health insurance risk assessment/pricing is expressly listed in Annex III. Other insurance workflows require their own intended-purpose analysis rather than automatic classification by industry.

Life & health pricing

Specified risk-assessment and pricing uses concerning natural persons are listed in Annex III.

Other insurance workflows

Claims, operations, marketing and fraud workflows should be classified by their actual intended purpose and any other applicable legal route.

Current timetable

Annex III readiness points to 2 December 2027.

Use the implementation period to document classification, roles, risk controls, data governance, oversight and evidence rather than waiting for the application date.
