The Legal Text: What Article 4 Actually Says
This single article creates a binding legal obligation that applies across the entire EU AI Act — regardless of whether your AI system is classified as high-risk, limited risk, or minimal risk. Every company that provides or deploys an AI system within the Act's scope must address AI literacy.
The Legal Definition of AI Literacy
The EU AI Act provides a formal definition in Article 3(56):
"AI literacy" means skills, knowledge and understanding that allow providers, deployers and affected persons, taking into account their respective rights and obligations in the context of this Regulation, to make an informed deployment of AI systems, as well as to gain awareness about the opportunities and risks of AI and possible harm it can cause.
Recital 20 of the Regulation expands this further: "In order to obtain the greatest benefits from AI systems while protecting fundamental rights, health and safety and to enable democratic control, AI literacy should equip providers, deployers and affected persons with the necessary notions to make informed decisions regarding AI systems."
The European Commission's AI literacy FAQ (published on digital-strategy.ec.europa.eu) confirms the scope of AI literacy under Recital 20 and Article 3(56) is broader than Article 4 alone. AI literacy is intended to benefit all relevant actors in the AI value chain, including affected persons — not only staff. The Commission states: "persons dealing with the operation and use of AI systems on behalf of providers/deployers" includes persons broadly under the organizational remit — contractors, service providers, and potentially clients.
When Did Article 4 Become Enforceable
Article 4 became applicable on February 2, 2025, as part of the first phase of the EU AI Act's implementation timeline under Article 113. This was the same date the prohibitions under Article 5 took effect.
The European Commission has confirmed explicitly: "Article 4 of the AI Act entered into application on 2 February 2025, therefore the obligation to take measures to ensure AI literacy of their staff already applies." If your company provides or deploys AI systems within the EU AI Act's scope, this obligation is not upcoming — it is active.
There is a practical enforcement nuance. The European Commission's AI literacy Q&A clarifies that supervision and enforcement by national market surveillance authorities begins on August 2, 2026. Enforcement of Article 4 falls under the remit of national competent authorities designated under Article 70 — not the AI Office. The AI Office coordinates with the AI Board to support implementation, but operational enforcement is national.
As of April 2026, formal enforcement actions specifically targeting Article 4 violations have not been publicly reported. However, several national authorities — including Germany's BNetzA and France's CNIL (in an advisory capacity on AI) — have signaled that AI literacy will be assessed as part of broader AI Act compliance reviews beginning in August 2026.
Who Must Comply
- Providers — companies that develop or place AI systems on the EU market, including US companies whose AI products serve EU customers
- Deployers — companies that use AI systems in their operations under their own authority, including US companies with EU-facing operations
- Persons beyond employees — the obligation covers "other persons dealing with the operation and use of AI systems on their behalf," which the Commission confirms may include contractors, service providers, and in some cases clients
Extraterritorial Reach for US Companies
If your US company falls within the EU AI Act's territorial scope — because your AI outputs affect EU users, you sell AI to EU customers, or you have EU subsidiaries — Article 4 applies. The same extraterritorial triggers that bring you within the Act's scope also trigger the AI literacy obligation.
What "Sufficient" Literacy Requires
The EU AI Act does not prescribe a specific curriculum, certification, or number of training hours. The European Commission's AI Office has explicitly confirmed: "There is no obligation for external training or external certification."
Article 4 specifies four proportionality factors:

- How the AI system works — its capabilities, limitations, and the logic of its outputs
- Awareness of risks — including bias, discrimination, errors, and potential harm to affected persons
- Applicable legal obligations — including the EU AI Act itself, GDPR where relevant, and sector-specific regulations
- Human oversight competence — particularly for high-risk AI systems where Article 14 requires effective human oversight
- Incident recognition — the ability to identify when an AI system is not functioning as intended and how to escalate
It does not require everyone to become a data scientist — literacy is proportionate to role. It does not mandate specific certifications — there is no "EU AI Literacy Certificate" required by law. It is not a one-time event — as AI systems evolve, literacy must be updated. It is not just an e-learning module — the obligation requires genuine understanding, not box-ticking.
Penalties and Enforcement
The penalty position around Article 4 is nuanced. Based on verified legal sources:
- No standalone direct fine for Article 4 alone. Latham & Watkins (January 2025) confirmed: "No direct fines or other sanctions will apply for violating the AI literacy requirements under Article 4." DLA Piper (August 2025) reached the same conclusion.
- Aggravating factor for other violations. Non-compliance with AI literacy is taken into account when regulators assess penalties for other EU AI Act violations. Ireland's Data Protection Commissioner Dale Sunderland has specifically stated that AI literacy requirements might not be enforced in isolation but could influence assessments of other violations.
- Civil liability exposure. From August 2, 2025 onward, providers and deployers may face civil liability if AI systems operated by inadequately trained staff cause harm to consumers, business partners, or third parties — even absent a direct regulatory fine (as noted by Latham & Watkins).
- Debated penalty tier. Some commentators cite Article 99(4) as a potential applicable tier (up to €7.5M or 1.5% of global turnover). However, the European Commission has not issued definitive guidance confirming this interpretation.
If your high-risk AI system causes harm due to bias, and an investigation reveals your staff lacked the literacy to identify or mitigate that bias, regulators will use this to justify more severe penalties within the €15M/3% tier. AI literacy is the foundation — if it fails, everything built on top of it is vulnerable to harsher enforcement.
AI Literacy Is the Foundation for High-Risk Compliance
With high-risk obligations arriving in August 2026, companies that have not addressed literacy face a compounding problem. The high-risk requirements — human oversight (Art. 14), risk management (Art. 9), technical documentation (Annex IV), post-market monitoring (Art. 72) — depend on staff who understand what they're working with.
Companies that establish AI literacy programs now are:
- Complying with an obligation already in force since February 2025
- Building a documented compliance track record that supervisory authorities will recognize
- Preparing the foundation for high-risk compliance, which cannot be achieved without literate staff
- Reducing operational risk from AI misuse, bias incidents, and reputational damage
How to Document Compliance
While the Act does not prescribe a documentation format, regulators will expect auditable evidence:
- Role-based training matrix — mapping each role to required topics based on AI interaction level and system risk classification
- Training records — who was trained, when, what content, what assessment results
- Training materials — actual content used, demonstrating depth and alignment with deployed AI systems
- Periodic update records — evidence that training is refreshed when systems change or new staff join
- Competency verification — assessments showing training was effective (quizzes, practical exercises, supervised periods)
- Gap analysis — how the organization assessed current literacy and identified improvement areas
