The Legal Text: What Article 4 Actually Says

"Providers and deployers of AI systems shall take measures to ensure, to their best extent, a sufficient level of AI literacy of their staff and other persons dealing with the operation and use of AI systems on their behalf, taking into account their technical knowledge, experience, education and training and the context the AI systems are to be used in, and considering the persons or groups of persons on whom the AI systems are to be used." — Article 4, Regulation (EU) 2024/1689 (Official Journal, 12 July 2024)

This single article creates a binding legal obligation that applies across the entire EU AI Act — regardless of whether your AI system is classified as high-risk, limited risk, or minimal risk. Every company that provides or deploys an AI system within the Act's scope must address AI literacy.

The Legal Definition of AI Literacy

The EU AI Act provides a formal definition in Article 3(56):

Article 3(56) — Statutory Definition

"AI literacy" means skills, knowledge and understanding that allow providers, deployers and affected persons, taking into account their respective rights and obligations in the context of this Regulation, to make an informed deployment of AI systems, as well as to gain awareness about the opportunities and risks of AI and possible harm it can cause.

Recital 20 of the Regulation expands this further: "In order to obtain the greatest benefits from AI systems while protecting fundamental rights, health and safety and to enable democratic control, AI literacy should equip providers, deployers and affected persons with the necessary notions to make informed decisions regarding AI systems."

The European Commission's AI literacy FAQ (published on digital-strategy.ec.europa.eu) confirms the scope of AI literacy under Recital 20 and Article 3(56) is broader than Article 4 alone. AI literacy is intended to benefit all relevant actors in the AI value chain, including affected persons — not only staff. The Commission states: "persons dealing with the operation and use of AI systems on behalf of providers/deployers" includes persons broadly under the organizational remit — contractors, service providers, and potentially clients.

When Did Article 4 Become Enforceable

Article 4 became applicable on February 2, 2025, as part of the first phase of the EU AI Act's implementation timeline under Article 113. This was the same date the prohibitions under Article 5 took effect.

Already in Force — Not a Future Obligation

The European Commission has confirmed explicitly: "Article 4 of the AI Act entered into application on 2 February 2025, therefore the obligation to take measures to ensure AI literacy of their staff already applies." If your company provides or deploys AI systems within the EU AI Act's scope, this obligation is not upcoming — it is active.

There is a practical enforcement nuance. The European Commission's AI literacy Q&A clarifies that supervision and enforcement by national market surveillance authorities begins on August 2, 2026. Enforcement of Article 4 falls under the remit of national competent authorities designated under Article 70 — not the AI Office. The AI Office coordinates with the AI Board to support implementation, but operational enforcement is national.

As of April 2026, formal enforcement actions specifically targeting Article 4 violations have not been publicly reported. However, several national authorities — including Germany's BNetzA and France's CNIL (in an advisory capacity on AI) — have signaled that AI literacy will be assessed as part of broader AI Act compliance reviews beginning in August 2026.

Who Must Comply

Extraterritorial Reach for US Companies

If your US company falls within the EU AI Act's territorial scope — because your AI outputs affect EU users, you sell AI to EU customers, or you have EU subsidiaries — Article 4 applies. The same extraterritorial triggers that bring you within the Act's scope also trigger the AI literacy obligation.

What "Sufficient" Literacy Requires

The EU AI Act does not prescribe a specific curriculum, certification, or number of training hours. The European Commission's AI Office has explicitly confirmed: "There is no obligation for external training or external certification."

It does not require everyone to become a data scientist — literacy is proportionate to role. It does not mandate specific certifications — there is no "EU AI Literacy Certificate" required by law. It is not a one-time event — as AI systems evolve, literacy must be updated. It is not just an e-learning module — the obligation requires genuine understanding, not box-ticking.
